That sounds like an AOTC rule. For 529 distributions, just make sure that the distribution happens in the same calendar year in which the expenses that the distribution covers were actually paid.
In my opinion, yes. There are no tax consequences to the 529 distribution (and therefore nothing to report on a tax return), unless some or all of the distribution was used for non-qualified expenses.
